The Graduate Connection® Online Community (the "Online Community") is provided by Harris Connect, Inc. ("Harris"), under contract with a particular educational institution ("the Institution"). The Online Community is designed to facilitate communication among members for personal or Institutional-related purposes. For the purposes of interpreting these Terms of Use, participants in the Online Community may be referred to as "User(s)", "Member(s)", or "Registrant(s)".
By clicking on the "Accept" button, you agree to strictly abide by the Online Community Terms of Use outlined herein. If you cannot or will not accept these Terms, please click on the "Do Not Accept" button to indicate that you decline to accept the policies and do not wish to register as a User of the Online Community.

The Online Community is password-protected to allow access by registered Members only. Although this precaution should effectively protect any personal information available through the Online Community from abuse or outside interference, a certain degree of privacy risk is faced any time information is shared over the Internet. Therefore, through the Online Directory feature of the Online Community, you have the ability to hide your information from being viewed by other community Members.
II. Policy and Guidelines for Proper Use
To safeguard the security and operation of the Online Community, Harris and the Institution have adopted certain guidelines and policies that are used to govern conduct within the Online Community.
A. Unauthorized copying, reproduction, republishing, uploading, downloading, posting, transmitting or duplicating any of the material is prohibited. You may download or copy any downloadable materials displayed on the Online Community for home, noncommercial and personal use only; provided, however, that you maintain all copyright, trademark and other notices contained in such material and you agree to abide by all additional copyright notices or restrictions contained in any material accessed through the Online Community.
B. Use of information or communications available through the Online Community for any commercial, public or political purposes is strictly prohibited. Prohibited activities include, but are not limited to, solicitations for commercial services, cold-calling of any kind or mass-mailings for commercial purposes. Information available through the Online Community may be used for specific personal and Institutional-related purposes only.
C. Users shall neither restrict nor inhibit any other User from enjoying any service on the Online Community. Posting of obscene materials or use of obscene language, posting of vulgar materials, or use of vulgar language, or use of abusive, defamatory, profane, or threatening language of any kind, will constitute a violation of these Terms of Use of the Online Community. Additionally, Users shall not upload, transmit, distribute or otherwise publish any materials containing a virus or any other harmful component.
D. All aliases adopted by Online Community Users are subject to approval by Harris to ensure that the proper image is associated with the Institution.
E. Users shall refrain from falsifying identity in order to gain access to another individual’s record. If Harris and/or the Institution believe that such falsification might have occurred, the User will be denied further access to the Online Community pending further investigation and, possibly, permanently. In cases where falsification of identity appears to have occurred in breach of any applicable Federal or state law, Harris and/or the Institution will report such occurrence(s) to appropriate law enforcement or Federal agency.
Harris and the Institution, jointly and severally, are not responsible for screening communications in advance, and will not actively monitor the use of the Online Community. For this reason, it is essential that the Members report any abuse or misuse of the Online Community to Harris or Institution. If Harris or Institution determines that a User's participation in the Online Community creates a liability for Harris or the Institution reasonably believes that User has violated the Terms of Use set forth herein, Harris reserves the right, in its/their sole discretion, to take actions against the User. Harris reserve the right to expel a User and deny a User further access to the Online Community if such User violates these policies or any applicable laws or regulations.
III. Limited Liability and Indemnity
The reliability of the information available through the Online Community is largely dependent upon the actions of Registrants. Harris and/or the Institution make no representation or warranty, expressly or impliedly, regarding the accuracy, reliability, completeness, or timeliness of this information.
Harris does not warrant that the Online Community web site will operate error-free or that the site and its server are free of computer viruses or other harmful material. To the fullest extent permitted by the law, Harris disclaims all warranties, including the warranties of merchantability, non-infringement, and fitness for particular purpose. In no event shall Harris and/or the Institution be liable for any damages whatsoever, including, without limitation, incidental, consequential, or punitive damages, resulting from the use of or inability to use information or materials available on the Online Community web site.
By using the Online Community web site, you agree to indemnify, defend, and hold harmless Harris and the Institution, and their respective agents, from and against any and all losses, claims, damages, costs, and expenses that may arise from your use of the Online Community web site or your breach of these Terms of Use. Harris will provide notice to you of any such action or claim, and reserves the right to participate, at its expense, in the investigation, settlement, and defense of any such action or claim.
Payment Method
Full access to the services (i.e., annual subscription) will be granted immediately upon an approved online transaction using one of the accepted credit cards. Once the subscription payment is made, the subscription fee will be non-refundable. Access will continue for 12 months, with subscriber being notified via email (if available) in advance of the subscription end date and offered the opportunity to renew the subscription at the then current rate.
Refund Policy
Once you have submitted payment of the Annual Subscription Fee of nine dollars and ninety-five cents ($9.95) for access to and use of the Online Community web site, it is understood that this full amount is and shall remain non-refundable due to the effort of setting up authentication of your record. Prior to your 12-month subscription elapsing, you will receive a renewal notification via email that the subscription will be running out.
Certification
By agreeing to these Terms of Use, you are certifying that you are at least 18 years old.
Password Information
You are responsible for securing your user name and password. Permitting the unauthorized use of your user name and password to a third party may result in termination of your membership and additional charges to your account.
Governing Law
These Terms of Use are governed by the laws of the State of New York, irrespective of the forum in which the Terms of Use or any part of it may come up for construction, interpretation or enforcement.
Dispute Resolution
Any dispute arising under or in connection with the Terms of Use shall be submitted for resolution by arbitration conducted in New York City in accordance with then-current Rules of the American Arbitration Association. Judgment upon any award rendered in such arbitration proceeding may be entered in any court of competent jurisdiction, or application may be made to such a court for a confirmation or judicial acceptance of such award, or for an order of enforcement or other legal remedy as the case may be. The fees and expenses of such arbitration, and the fees of the arbitrators, shall be borne equally by the respective parties. Nothing contained herein shall abrogate or limit either party's right to obtain equitable relief in connection with the Terms of Use in a court of competent jurisdiction.
